The recent decision by the High Court of Justice to quash a planning decision by Ceredigion County Council to allow the erection of a wind turbine sends an important message to local planning authorities. It reminds authorities that planning is a legal process. Professional planning officers and elected Councillors on the Development Control Committee are required to comply with their own planning policies, as outlined in the Council's adopted Local Development Plan, and required to comply with planning process, as outlined in the Town & Country Planning {Development Management Procedure} {Wales} {Order} 2012. Any failure to comply and Council should not be surprised that a High Court Judge has quashed the planning decision. It is the cost of litigation that prevents many members of the public from achieving justice.
